The rules of the purchase, in plain language: you order online, we confirm by phone, the parcel is delivered, you pay the courier in cash. Prices are in euro and include VAT.

11.Who the contract is between
These terms govern every sale made through marketsaves.com. The seller is WHATECH MOBILE CO., LIMITED, Room 505, 5/F, Beverley Commercial Centre, 87-105 Chatham Road South, Tsim Sha Tsui, Kowloon, Hong Kong, trading as MarketSaves ("we", "us"). The buyer is the person named in the order form ("you").
Adverts for this shop are run by a separate advertising company. It acts only as advertising operator. It is not the seller, is not a party to this contract and has no obligations towards you under it. Full details of both companies are on the Company Details page.
22.Who can order, and what these terms cover
The shop is meant for consumers: adults aged 18 or over who buy for private use and have a delivery address in one of the 10 countries listed in the Delivery Policy. If you buy for a business, the consumer rights described here (withdrawal, legal guarantee for consumers) do not apply to you in the same way; contact us before ordering.
The contract is concluded in English. The version of these terms that applies is the one published on the day you send the order. We keep a record of each order; you can ask us for a copy of yours at any time. The Delivery Policy, the Returns and Refunds page and the Privacy Policy form part of these terms.
33.Products and descriptions
We describe each product by its main characteristics: what it does, its measurements and capacities, and what is in the box. Photos show the product itself; colours can differ slightly from screen to screen. Small changes made by the manufacturer that do not affect function or quality (for example the design of the packaging) can occur between batches.
Products are offered while stocks last. A product marked as sold out cannot be ordered. If an item turns out to be unavailable after you ordered it, we tell you on the confirmation call or by message, and the order is cancelled at no cost unless you agree to an alternative.
44.Prices
Prices are in euro (EUR) and include VAT. The delivery charge is a flat 4,99 € per order and is shown separately. Before you confirm, the order summary shows the total: product price multiplied by quantity, plus delivery. You will not be asked to pay more than that total.
Where a product shows a struck-through price next to the current one, the struck-through figure is our regular list price for that product and the current figure is what you pay. Offers carry no end date unless one is stated; we may change prices at any time, but a change never affects an order that has already been confirmed.
If a price is obviously wrong (for example a misplaced decimal point), we tell you on the confirmation call and you decide whether to go ahead at the correct price or drop the order.
55.How your order becomes a contract
- The site is an invitation. Showing products and prices is not yet a binding offer from us.
- Your order is the offer. You choose the product and quantity, fill in the delivery form, review the summary with the total, accept these terms and press the confirm button. At that moment you make us an offer to buy. The page you see next, and the email you receive if you gave an address, only acknowledge that the order arrived.
- We accept by confirming. We phone you to check the order. The contract is concluded when we confirm the order with you on that call or, if earlier, when we hand the goods to the carrier. Until then you may withdraw the offer, and we may decline it.
We may decline an order when we cannot reach you by phone, when the address is incomplete or outside our delivery area, when the item is out of stock, or when earlier parcels sent to the same phone number or address were refused or left uncollected without reason. A declined order costs you nothing.
Before sending, you can correct input errors by going back in the form. After sending, corrections are made on the confirmation call.
66.Payment: cash on delivery
The only payment method is cash on delivery. You pay the total shown in your order summary, in cash, to the courier who hands you the parcel. The courier collects the amount on our behalf; payment to the courier discharges your debt to us.
We do not take card details, deposits or bank transfers in advance, and we do not store any payment data. The goods remain our property until the courier has been paid.
77.Delivery and transfer of risk
We deliver to the address in your order within the times set out in the Delivery Policy: 1–2 working days of handling after the confirmation call, then 3–7 working days in transit depending on the country. In any event we deliver no later than 30 days after the contract is concluded. If we miss that limit, you may set us a further reasonable period and, if we miss that too, end the contract; since nothing has been paid, nothing is owed.
The risk of loss or damage passes to you when you, or a person you have named other than the carrier, take physical possession of the goods. Until then the goods travel at our risk.
By ordering you agree to be reachable on the phone number you gave and to be at the address, or to have someone there who can pay and receive the parcel. If a parcel comes back to us because it was refused or never collected without a valid reason, the order is cancelled; we reserve the right to refuse later cash-on-delivery orders from the same phone number or address.
88.Right of withdrawal
As a consumer you may withdraw from the contract within 14 days of receiving the goods, without giving a reason. You bear the direct cost of returning the goods; we refund the price and the outbound delivery charge by bank transfer. 99.Legal guarantee of conformity
We are legally bound to deliver goods that conform to the contract. If a lack of conformity shows itself within two years of delivery, or within any longer period granted by the law of the country where you live, you are entitled to repair or replacement at no cost and, where those fail, to a price reduction or to end the contract and be refunded. How to claim is explained in Returns and Refunds. Nothing in these terms limits that guarantee.
1010.Safe use of the products
Read the instructions supplied with the product before first use and use it only for the purpose it is made for. Tools, chargers, batteries and kitchen appliances in particular must be used as the manual says. Keep small parts and packaging away from children. If a manual is missing or is not in a language you understand, write to us and we will send one.
1111.Our liability
We are liable for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not liable for loss that was not foreseeable to both of us when the contract was made, for loss caused by use of a product against its instructions, or for business losses such as lost profit or business interruption, since the goods are sold for private use.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, for defective products under product-liability law, or for any right that consumer law does not allow us to limit.
We are not in breach when an event beyond our reasonable control (for example a carrier strike, extreme weather, a border closure or a failure of public networks) delays performance. We tell you as soon as we can; if the delay goes beyond 30 days, either of us may cancel the order at no cost.
1212.Personal data
To perform the contract we process the details you enter in the order form and pass the delivery details to the carrier. WHATECH MOBILE CO., LIMITED is the data controller. The Privacy Policy explains what is processed, why, for how long and what your rights are.
1313.Complaints and disputes
Send complaints to help@marketsaves.com or through the contact form, with your order reference. We acknowledge a complaint within two working days and aim to resolve it within fourteen days.
We are not obliged to take part in dispute resolution before a consumer arbitration or mediation body and have not committed in advance to do so; if you propose one, we will consider it in good faith. For free advice on a purchase from a trader in another EU country, you can turn to the European Consumer Centre in the country where you live.
1414.Governing law and courts
These terms and every contract made under them are governed by the law of Hong Kong, the country where the seller is established.

1515.Changes and general points
We may update these terms, for example when the law or our service changes. The date at the top shows the current version. An order is always governed by the version in force when it was sent.
If a court finds one clause invalid, the rest of the terms stay in force. If we do not insist on a right at once, we can still do so later. You may not transfer the contract to someone else without our agreement, though the legal guarantee follows the goods where national law provides for it.
